PRIVACY POLICY

BLK Works Inc. (“BLK,” “we,” “us” and “our”) respects your privacy. This Privacy Policy explains how BLK collects, uses, discloses, retains and protects personal information in connection with:

  • https://bronwenkettleson.com/ (the “Site”);

  • BLK’s memberships, classes, recordings, private instruction and other services (collectively, the “Services”);

  • BLK’s Substack publication;

  • communications with BLK; and

  • BLK’s official social media accounts and other public-facing platforms.

This Privacy Policy is intended to comply with British Columbia’s Personal Information Protection Act and other Canadian privacy laws that apply to BLK.

1. Privacy Officer

BLK has designated the following person to be responsible for its privacy practices:

Questions, access or correction requests, withdrawal-of-consent requests and privacy complaints may be sent to the Privacy Officer.

2. What Is Personal Information?

“Personal information” means information about an identifiable individual. It does not include information that has been aggregated or de-identified so that it can no longer reasonably be associated with an identifiable person.

3. Personal Information BLK May Collect

Depending on how you interact with BLK, BLK may collect the following information.

3.1. Identity and Contact Information

BLK may collect your:

  • name;

  • email address;

  • telephone number;

  • mailing or billing address;

  • age or confirmation that you have reached the age of majority in your jurisdiction of residence;

  • display name or username; and

  • emergency-contact information, if you choose to provide it.

If you provide information about an emergency contact, you confirm that you have that person’s permission to provide the information to BLK.

3.2. Membership, Purchase and Transaction Information

BLK may collect:

  • the membership or Service you selected;

  • purchase and renewal dates;

  • amounts charged and payment status;

  • billing information;

  • cancellation and refund information;

  • Industry Membership eligibility information, where requested;

  • Substack invitation and access status; and

  • transaction and purchase-confirmation records.

Payment-card information is processed by BLK’s payment provider. BLK does not ordinarily receive or retain your complete payment-card number. BLK may receive limited payment information, such as the card type, last four digits, billing information, payment status and transaction identifier.

3.3. Agreements and Waivers

BLK may retain records showing that you:

  • accepted BLK’s Service Agreement;

  • read, accepted or electronically signed BLK’s Waiver and Release of Liability;

  • confirmed your age;

  • provided an electronic signature; and

  • completed the applicable purchase or registration process.

These records may include your name, signature, email address, IP address, date, time and related transaction information.

3.4. Participation and Health-Related Information

When relevant to a live or private Service, you may voluntarily provide information concerning:

  • your movement experience or goals;

  • an injury, medical condition or physical limitation;

  • pregnancy or postpartum status;

  • medication or professional medical advice affecting participation;

  • an accommodation request;

  • an emergency contact; or

  • your location while participating in a virtual Service.

BLK collects this information only to the extent reasonably necessary to administer the Service, respond to your request, modify instruction where appropriate or address a safety concern. BLK does not use this information to diagnose or provide medical treatment.

3.5. Recordings and Class Participation

When BLK records a livestreamed class, a recording may contain your:

  • image, likeness and voice;

  • name or display name;

  • movements;

  • comments or questions;

  • chat messages; and

  • visible background.

BLK will provide notice when a live class is being recorded. The collection and use of class-recording information are also addressed in BLK’s Service Agreement.

3.6. Communications and Submitted Content

BLK may collect information contained in:

  • emails and direct messages;

  • questions, feedback and support requests;

  • survey or form responses;

  • testimonials provided with permission;

  • social media posts or messages sent to BLK;

  • content that tags or mentions an official BLK or Bronwen Kettleson account; and

  • photographs, videos, audio or other content voluntarily submitted to BLK.

Use of submitted or tagged content is also governed by BLK’s Website and Social Media Terms and, where applicable, the Service Agreement.

3.7. Technical and Website Information

When you use the Site, BLK and its service providers may automatically collect:

  • IP address;

  • browser and device information;

  • operating system;

  • approximate location derived from an IP address;

  • pages viewed;

  • referring website;

  • dates and times of visits;

  • interactions with the Site;

  • cookie or similar identifiers; and

  • website security and diagnostic information.

3.8. Communication Preferences

BLK may record whether you have subscribed, unsubscribed or otherwise indicated a preference concerning newsletters and promotional communications.

4. How BLK Collects Personal Information

BLK may collect personal information:

  • directly from you when you complete a form, make a purchase, sign a waiver, communicate with BLK or participate in a Service;

  • automatically through the Site, cookies and analytics tools;

  • through a service provider acting for BLK;

  • through a payment, membership, video, scheduling or communication platform;

  • from another person where you have authorized that person to provide the information; or

  • from public social media activity where you submit content to BLK, tag or mention an official account, or otherwise clearly invite BLK to view or share the content.

BLK will collect personal information only for purposes that a reasonable person would consider appropriate in the circumstances.

5. How BLK Uses Personal Information

BLK may use personal information to:

  • process purchases and recurring membership payments;

  • provide and administer memberships, classes and other Services;

  • create and maintain customer and membership records;

  • provide complimentary paid access to BLK’s Substack publication;

  • send purchase confirmations, access instructions and service communications;

  • administer cancellations, refunds and payment disputes;

  • schedule and deliver livestreamed or private Services;

  • respond to questions, support requests and feedback;

  • maintain records of agreements, waivers and consent;

  • assess Industry Membership eligibility;

  • provide reasonable modifications or respond to information voluntarily disclosed about participation;

  • contact an emergency contact where reasonably necessary;

  • record and distribute livestreamed classes as described in the Service Agreement;

  • administer submitted or tagged social media content;

  • send newsletters and promotional communications where permitted;

  • maintain the security and functionality of the Site and Services;

  • detect or prevent fraud, misuse or security incidents;

  • understand how the Site and Services are used;

  • improve BLK’s content, Services and communications;

  • maintain accounting, tax, insurance and business records;

  • establish, exercise or defend legal rights; and

  • comply with applicable laws, lawful requests and regulatory requirements.

BLK will not use personal information for a materially different purpose without additional consent unless the use is otherwise permitted or required by law.

6. Consent and Withdrawal of Consent

BLK obtains express, implied or deemed consent as appropriate to the sensitivity of the information and the circumstances.

By voluntarily providing personal information for an obvious purpose, you consent to BLK collecting, using and disclosing that information for that purpose. BLK may request express consent for more sensitive information or for uses that would not be obvious from the circumstances.

You may withdraw consent by contacting BLK’s Privacy Officer and providing reasonable notice. Withdrawal does not affect collection, use or disclosure that occurred before BLK received the request.

Withdrawal may prevent BLK from continuing to provide a Service where the information is reasonably necessary to provide that Service. BLK may also retain or use information where required or permitted by law, including where withdrawal would prevent BLK from fulfilling a legal obligation.

BLK will not require consent to collect, use or disclose information beyond what is reasonably necessary to provide a requested product or Service.

7. Marketing Communications

BLK may send newsletters and other commercial electronic messages where BLK has the recipient’s express consent, implied consent or another lawful basis for doing so.

Commercial electronic messages will include the identification and contact information required by law and a working unsubscribe mechanism. You may unsubscribe using the link provided in an email or by contacting blkworksinc@gmail.com.

Unsubscribing from promotional emails does not prevent BLK from sending non-promotional communications reasonably necessary to administer a purchase, membership, class, account, cancellation, safety matter or legal obligation. Unsubscribing from Substack emails does not, by itself, cancel a BLK membership.

8. Service Providers and Other Disclosures

BLK may provide personal information to service providers that assist BLK with:

  • website hosting and ecommerce;

  • payment processing;

  • membership and publication delivery;

  • livestreaming and video hosting;

  • online forms and electronic signatures;

  • file storage;

  • accounting and recordkeeping;

  • email and communications;

  • analytics and website security; and

  • professional legal, accounting or insurance services.

Depending on the Services used, these providers may include:

  • Squarespace for website hosting, ecommerce and analytics;

  • Stripe and PayPal for payment processing;

  • Substack for newsletters, publications and complimentary paid member access;

  • Zoom for virtual classes and meetings;

  • Vimeo for video hosting and delivery;

  • Google for file storage, email or related services;

  • Jotform for forms and electronic records; 

  • Wave for accounting and financial recordkeeping; and

  • YouTube for video hosting and delivery.

BLK may also disclose personal information:

  • with your consent;

  • to an emergency contact where reasonably necessary;

  • to a lawyer, accountant, insurer or other professional adviser;

  • in connection with a proposed sale, reorganization or transfer of all or part of BLK’s business, subject to appropriate confidentiality requirements;

  • to investigate fraud, unlawful activity or a security incident;

  • where there are reasonable grounds to believe disclosure is necessary to address a compelling health or safety concern; or

  • where required or permitted by law, court order or lawful government request.

BLK does not sell personal information.

Some service providers may store or process information outside British Columbia or Canada. Personal information processed in another jurisdiction may be subject to the laws of that jurisdiction and may be accessible to its courts, governments or law-enforcement authorities.

BLK remains responsible for personal information under its control and takes reasonable steps to select and use service providers capable of protecting it appropriately.

9. Third-Party Platforms and Links

The Site and BLK’s communications may contain links to websites or platforms operated independently by third parties. Information you provide directly to an independent third party is governed by that third party’s privacy policy and terms.

BLK’s Privacy Policy applies to personal information under BLK’s custody or control. It does not govern the independent collection and use of information by social media platforms or other third parties acting for their own purposes.

10. Cookies and Analytics

The Site and its service providers may use cookies and similar technologies to:

  • operate essential Site features;

  • remember settings and preferences;

  • maintain Site security;

  • understand Site traffic and use;

  • identify technical problems; and

  • improve the Site and its content.

Cookies and associated information may include identifiers, IP addresses, device information and Site-usage data. Some of this information may constitute personal information.

You may adjust your browser settings to block or delete cookies. Blocking essential cookies may affect Site functionality. Where required by applicable law, BLK will request consent before using non-essential cookies.

BLK does not currently respond to browser-initiated Do Not Track signals because there is no generally accepted standard for responding to them.

11. Retention

BLK retains personal information only for as long as reasonably necessary to:

  • fulfil the purposes for which it was collected;

  • provide and administer the Services;

  • maintain appropriate business, transaction and consent records;

  • comply with tax, accounting, insurance and legal requirements;

  • resolve disputes; or

  • establish, exercise or defend legal rights.

Where BLK uses personal information to make a decision that directly affects an individual, BLK will retain that information for at least one year after the decision where required by law.

When identifiable personal information is no longer reasonably required for a legal or business purpose, BLK will securely destroy it or remove the means by which it can be associated with an identifiable individual.

A deletion request may not result in immediate deletion where continued retention is required or permitted for legal, contractual, security or legitimate business purposes.

12. Safeguards

BLK uses reasonable administrative, technical and physical safeguards appropriate to the sensitivity of the information. These may include:

  • password-protected accounts and devices;

  • access restrictions;

  • secure third-party platforms;

  • appropriate storage and disposal practices;

  • multifactor authentication where available; and

  • limiting access to people who reasonably require the information.

No electronic transmission or storage system is completely secure. BLK cannot guarantee absolute security, but it will take reasonable steps to protect personal information under its control and respond appropriately to suspected privacy or security incidents.

13. Access, Correction and Other Requests

You may submit a written request to:

  • access personal information about you under BLK’s control;

  • obtain information about how your personal information has been used and disclosed;

  • request correction of inaccurate or incomplete information;

  • withdraw consent;

  • request deletion of information, subject to applicable retention requirements; or

  • make a privacy complaint.

Send requests to BLK’s Privacy Officer at blkworksinc@gmail.com. Your request should provide enough detail to allow BLK to identify you and the information concerned. BLK may request reasonable information to verify your identity before responding.

BLK will ordinarily respond to a written access or correction request within 30 days, subject to any extension, exception or refusal permitted by applicable law. Access may be limited where disclosure would reveal another person’s personal information, legally privileged information or other information that BLK is permitted or required to withhold.

Where permitted by law, BLK may charge a minimal fee for access. If a fee applies, BLK will provide a written estimate before processing the request.

14. Age of Majority

BLK’s paid Services are intended only for individuals who have reached the age of majority in their jurisdiction of residence. BLK does not knowingly accept purchases, membership registrations, waivers or Service participation from minors. BLK does not knowingly accept purchases, membership registrations, waivers or Service participation from minors.

If BLK learns that it has collected personal information from a minor in connection with a restricted Service, BLK will take reasonable steps to delete the information unless retention is required or permitted by law.

A parent or guardian who believes that BLK has collected personal information from a minor may contact BLK’s Privacy Officer.

15. Changes to This Privacy Policy

BLK may update this Privacy Policy to reflect changes in its practices, Services, service providers or legal obligations. The revised policy will be posted on the Site with an updated revision date.

Material changes will apply prospectively. Where required by law, BLK will provide additional notice or obtain additional consent before using or disclosing previously collected personal information for a materially different purpose.
